Terms of Service

These Terms of Service (ā€œTermsā€) govern your access to and use of the Civic Atlas website (the ā€œSiteā€). The Site is operated by Civic Atlas B.V. (ā€œCivic Atlasā€, ā€œweā€, ā€œusā€). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

Civic Atlas supports a community learning and events platform focused on Canada. The Site provides informational pages, resources, community and event listings, and forms that let people request membership, ask questions, or register interest. The Site is not a government service and is not affiliated with any Canadian federal, provincial, or municipal authority.

1. Acceptance, Eligibility, and Updates

By accessing the Site, you confirm that you are at least 16 years old and that you have the legal capacity to enter into these Terms. If you are under 18, you should use the Site under the supervision of a parent or guardian.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the ā€œLast Updatedā€ date. Changes become effective 14 days after posting unless a shorter timeframe is required for security or legal reasons. Your continued use of the Site after the effective date means you accept the updated Terms.

2. Important Disclaimers

The Site is provided for community information and participation support. It does not provide financial, investment, or trading services, and nothing on the Site should be interpreted as financial advice. Event and community availability can change; always review the relevant detail page or contact us for confirmation.

The Site may describe communities, events, resources, and participation guidelines. Any examples, templates, or ā€œhow-toā€ materials are general information. You are responsible for how you apply information from the Site to your own circumstances.

3. What We Provide

The Site may include (a) community listings and topic categories, (b) event listings with schedules, formats, and accessibility notes, (c) educational resources such as guides and summaries, and (d) contact and registration interest forms. We may add, remove, or modify features at any time.

Submitting a form on the Site does not guarantee membership acceptance, event placement, or partnership approval. Some requests require manual review and follow-up questions. We aim to respond within one business day, but response times can vary depending on volume and the nature of your request.

4. Acceptable Use

You agree to use the Site in a lawful, respectful manner. You must not:

  • Attempt to access, probe, or test the vulnerability of the Site or any related systems, or bypass security or rate limits.
  • Use automated means (bots, scrapers, crawlers) to extract data from the Site without our prior written consent.
  • Submit false, misleading, or impersonated information in any form submissions, including pretending to represent an organization you do not represent.
  • Upload or transmit malware, attempt phishing, or distribute harmful code.
  • Send spam, bulk messages, or repeated submissions intended to disrupt normal operations.
  • Post or share personal data of third parties without their permission (including contact details or private communications).
  • Use the Site in a way that violates applicable sanctions or export control laws, or access the Site from a region where doing so is unlawful.

If we believe there is abusive behavior or misuse (including repeated automated submissions), we may block access, limit functionality, or disregard submissions without prior notice.

5. User Submissions (Forms and Messages)

When you submit information through the Site (for example, a message, membership request, or event interest), you grant us permission to use that information for operational purposes: responding to you, routing your request, maintaining an internal record for continuity, and improving our processes. We do not use your form message as marketing copy and we do not sell your personal data.

You agree not to include sensitive personal details in free-text fields. If your request concerns privacy rights (for example, access or deletion), keep the message high level; we will reply with verification steps. Details about personal data processing are in our Privacy Policy.

6. Intellectual Property

The Site and its content—including text, design, layout, logos, interfaces, and code—are owned by or licensed to Civic Atlas B.V. and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use.

You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Site without our prior written consent, except where such use is permitted by applicable law. If you want to reuse a resource or excerpt for a community initiative, contact us to discuss attribution and scope.

7. Third-Party Services and Links

The Site may reference third-party websites, tools, or resources. Any such links are provided for convenience. Civic Atlas does not control third-party sites and is not responsible for their content, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.

8. Disclaimer of Warranties

The Site is provided on an ā€œas isā€ and ā€œas availableā€ basis. To the maximum extent permitted by law, Civic Atlas disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site will be complete, current, or suitable for your purposes.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Civic Atlas B.V. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site.

To the extent Civic Atlas is found liable, our total liability for all claims arising from or related to the Site will be limited to the greater of (a) the amount you paid to Civic Atlas in the 12 months before the claim arose (if any), or (b) €100.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Civic Atlas B.V., its directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Site, (b) your submissions through the Site, or (c) your violation of these Terms or applicable law.

11. Force Majeure

Civic Atlas will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, internet or hosting outages, cloud provider failures, or cyberattacks.

12. International Use

The Site is operated from the Netherlands and is intended to support a Canada-focused community scope. We make no representation that the Site is appropriate or legally available in all locations. You are responsible for compliance with local laws when accessing or using the Site.

13. Governing Law and Venue

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. The competent courts of Amsterdam, the Netherlands, will have exclusive jurisdiction over disputes arising out of or related to these Terms or the Site, unless mandatory consumer protection law provides otherwise.

If you are a consumer habitually resident in the European Union, you may also benefit from mandatory provisions of the consumer protection laws of your country of residence.

14. Dispute Resolution (Informal First)

Before starting a formal proceeding, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Please email [email protected] with the subject line ā€œTerms Disputeā€ and include a short description of the issue and what resolution you are seeking.

15. Termination

We may suspend or terminate access to the Site if we reasonably believe that you have violated these Terms or that your use poses a security risk. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Civic Atlas regarding your use of the Site.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, restructuring, or sale of assets.

19. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

20. Electronic Communications

You consent to receive communications from us electronically, including by email and by notices posted on the Site. You agree that electronic agreements and notices satisfy legal requirements for written communications, consistent with applicable EU and Netherlands law.
